Terms and Conditions of Mountain Guiding and Medical Solutions

Registration by telephone, letter, fax or e-mail. Once received, your registration is a binding contract, even before first payment. By registering, you accept mt Terms and Conditions as an integral part of the contractual relationship between both parties; yourself, the client and myself; Mathias Hediger. Once registration is received, you will then receive a confirmation/ invoice and a detailed program. 

Insurance

Adequate accident and health insurance to cover the activities participated in is the sole responsibility of the client.

Cancellation

Cancellation must be in writing and the following costs are incurred;

  • to 30 days before the course starts CHF 50 -
  • up to 20 days before the course: 50% of the invoice amount
  • up to 10 days before the course: 80% of the invoice amount
  • later or on the road: 100% of invoice

Cancellation insurance is highly recommended

Liability and compensation

As a certified paramedic, ski, mountain and canyoning guide, I offer you maximum security. However, a residual risk cannot be ruled out. Upon registration you agree to recognise the presence of such risk in the outdoor environment. In the case of a third party organising or providing services including but not exclusive to; accommodation, transport and guides I Mathias Hediger/ Mountain Medical Rescue accept no liability.

Cancellation Policy

If the minimum number of clients is not reached, I am entitled seven days before the tour starts to withdraw from the contract. There may be the option for the client to accept a corresponding adjustment of the price. If the client does not accept this adjustment, payment will be refunded in full. Other claims are excluded.

I reserve the right to cancel the trip in the event of and not limited to; unfavourable weather conditions or conditions out of my reasonable control. In the case of cancellation due to these factors, payment will be refunded minus the already claimed benefits in the form of a voucher.

Program changes

Heading into the wild, we are dependant on natural conditions and weather. In agreement with the client, changes can be made for safety reasons. Any additional costs incurred by and not exclusive to; natural events and conditions out of my reasonable control shall be charged to the client. If the client does not accept the proposed changes and chooses to leave the program, the client will incur 80% of the tour costs.

Jurisdiction, complaints, Applicable Law

Jurisdiction is CH - Luzern (LU). In addition, Swiss law shall apply to all legal questions. All findings shall be communicated in writing and dated.
